PROCESSING OF PERSONAL DATA
At the time of ordering, the photographer obtains the client's personal data for processing, i.e. name, surname, date of birth, permanent address, address for delivery in document form, email address and telephone number. The protection of this personal data is subject to Regulation (EU) No 2016/679 of the European Parliament and of the Council.
This personal data is provided for the purpose of providing services and carrying out mutual communication between the photographer and the client.
ORDER
An order is a confirmation of an offer (by email, Facebook/Instagram message or text message) between the photographer and the client for the provision of services.
After mutual agreement between the parties, the photographer will determine the most suitable available photography date for the client.
The booking of the date can be considered binding upon receipt of the set booking fee. Until this time, the appointment cannot be considered booked.
PAYMENT AND DEPOSIT
An invoice is issued for the booking fee and once this has been paid, the booking of the date is valid.
The remaining total amount of the photography fee is due within five working days of the photography booking by bank transfer.
If the price of the selected photo package or any additional charges for additional services beyond the package are not paid, the photographer reserves the right not to proceed with the job until the payment is properly made.
The client has the right to cancel the order no later than 3 months before the date of the photography order. In this case, 25% of the booking fee will be refunded less documented and necessarily incurred costs associated with any preparations already made by the photographer. In the event of non-compliance with this 3 month period, the booking fee will be forfeited in full to the photographer. This does not apply if both parties agree otherwise.
In the event that the client fails to attend the shoot at the agreed date and time, the client is liable for the full amount of the photography fee.
If the client is delayed more than 20 minutes without prior notice, the photographer reserves the right to cancel the shoot and leave the studio or the agreed location. The photographer is entitled to the full amount of photography fee.
PHOTO PREVIEWS
In the event that previews of the photographs are provided to the client, it is not allowed to publish, share, store, screenshot or edit them anywhere without the photographer's consent according to the Copyright Act No. 121/2000 Coll.
The previews that are sent represent the best images from the shoot and their selection is made exclusively by the photographer. Their number is not fixed, but always allows for a sufficient selection in relation to the chosen package.
The client must send back their selection for editing as soon as possible, but no later than one week after receiving them. If the selection for photo editing is sent after this deadline, the photographer reserves the right to extend the delivery time (see Delivery Time).
Once the job is completed, the preview gallery created is deleted.
DELIVERY OF PHOTOGRAPHS AND DELIVERY TIME
The delivery time of the finished edited photographs in electronic form is basically 17 working days from the day of the photo shoot.
In case of an order with a client's selection of photographs, the 17-day period is calculated from the date the photographs were sent for editing.
The client has the option of an "express delivery" of the order in digital form within 5 days. This option means an increase in the total price of the package by 85 EUR.
All finished and edited photographs will be received by the client in full size in JPG format through an online gallery.
The client does not have the option to receive unedited photographs, even by agreement.
PRINTING AND CLAIMS
The client must inform the photographer of any complaints about retouching immediately after viewing the photographs, but no later than three days after delivery. Late comments will not be taken into account.
Photographs are developed by a verified Czech supplier on high quality photo paper.
Complaints about printed photographs can only be made on the basis of visible printing defects (scratches, streaks and other visible defects), and not for color or brightness/darkness of the print.
Dissatisfaction or disagreement with the photographer's style and approach is also not a reason for a complaint.
It is not acceptable to complain about the color of the final photographs, the cropping of the photographs, or the client's idea of editing the photographs that is completely different from the photographer's style.
The client's dissatisfaction with his/her appearance cannot be considered as a reason for a complaint.
The photographer is not responsible for the client's unsatisfactory results due to poor weather conditions, bad lighting conditions, or other circumstances that prevent her from achieving and delivering a higher quality of photographs and that she cannot technically or artistically compensate for or edit, nor for the imperfect content of the photographs in the case that obstacles are placed by the photographed persons. Ordering photographs for editing and printing is binding - if the customer gives up on printed photographs within the chosen package, the price is not adjusted.
COMPENSATION FOR DAMAGE
The client is fully liable for any damage caused by him/her to the equipment and is obliged to compensate for the full amount of the damage incurred, not in terms of time but in terms of the cost of new equipment.
In the case of event photography, the client is also fully liable for any damage caused by visitors and staff to the equipment and is obliged to compensate for the damage in its full amount, not in terms of time but in terms of the cost of new equipment.
ARCHIVING OF PHOTOGRAPHS
Unedited proofs will be archived for 1 month from the date the selection is sent.
Edited photos are archived by the photographer for one year. She can therefore resend them electronically to the client within this time.
CONSENT TO PROVIDE PHOTOGRAPHS
If the client does not wish their photographs to be published and used for the photographer's presentation purposes, this must be notified in writing in advance. If the client fails to do so, this will be taken as consent.
COPYRIGHT AND PROPERTY RIGHTS
The client is only allowed to use the photographs for personal purposes, unless stated otherwise in the contract. The client is not allowed to edit the photographs in any way. All photographs provided to the client remain the property of the photographer's intellectual property and the client is not authorized to use them for commercial purposes, sell them to third parties, unless they have written consent from the photographer.
